The Republican Vision

Take a look at this article. It is written by Ed Whelan of NRO. The article blasts the appointment of William Brennan in 1957. Whelan says:

In his 34 years on the Court, Brennan deploys his impressive backroom political skills in the service of liberal judicial activism. It is doubtful that anyone has done more to misshape the Supreme Court’s understanding of the Constitution.

What does he base this statement on? Given NRO's ultra-Republican stance, you may have guessed it: condoms, abortion, and sex. 3 of the 4 cases he cites involve these items (there is also a school funding case he references that I don't entirely understand.) I don't know much about Brennan, but if this is the extent of his "misshaping of the understanding of the Constitution", then he doesn't seem like such a bad guy to me. Whelan's article has just highlighted Brennan not allowing the government to interfere in people's sex life. Fine by me, but apparently not to Mr. Whelan.

That's right, Ed... over-regulating sex is part of Republican small government, isn't it?
